The Privacy Act 1998 (Cth) and the associated Australian Privacy Principles (together "the Act") set out certain requirements for the collection, use, disclosure and handling of your personal information.

When you register, and apply for a position with Williams-Sonoma, Inc. or one of its related entities, the personal information that we collect from you may be used for the purpose of assessing your application or for any other purpose required or permitted by law, including:

  • to assess your suitability for the position(s) you apply for;
  • to conduct any or all of the following pre-employment screening checks:
    • confirmation of education and / or previous employment;
    • reference checks;
    • confirmation of professional memberships;

If your application is unsuccessful or you choose not to accept any offer of employment we make, the information will not be held for longer than necessary, after which time it will be deidentified or destroyed. If your application is successful, the information will form part of your employment file and we will be entitled to process it for all relevant purposes in connection with your employment. As the information will then form part of an employee record, we are no longer required to meet certain requirements contained in the Act in relation to that information.

If you choose to register for email alerts about future vacancies, your name and email address will be used solely for the purpose of providing you with details of vacancies which match your selected criteria. You can withdraw your consent to receive such email alerts at any time by contacting us using the contact details below. We do not sell or pass on your details to any other organisation or use them for any other purpose ourselves without your consent.

We store your personal information in the United States. In using your personal information for the purposes outlined above, it may be necessary for us to:

Job Applicant Information We Collect and Use

When you create a job applicant profile on the WSI Careers Site or otherwise apply for a job at WSI, we collect personal information including your name, contact information (such as mailing address, phone number and/or email address), education history, experience and history, skills and interests, availability, confirmation that you are over the age of majority in your province, and any other information you voluntarily provide to us in your application, resume, cover letter, or interview process. We use this information to evaluate your qualifications and suitability for the desired position, process your application, and contact you for further information. We may also keep this information on file to consider you for future job opportunities or to otherwise meet legal or business requirements. If you accept an offer of employment, this information will be used as part of the onboarding process and will form part of your employee file.

As part of the job application process, we may also collect personal information in the course of background verifications, including, but not limited to, a criminal background check, a job reference check, and verification of any information you have provided.

Job Alerts

If you sign-up to receive job alerts by email, we will send you notifications of new WSI jobs that meet your interests and experience. You can stop receiving job alerts by email at any time by following the “unsubscribe” instructions included in each email and text message.

How we Share Personal Information

We may share personal information with third parties (including our affiliates) who provide services on our behalf, including hosting the Careers Site, conducting background verifications, and assessing job applications.

Your personal information may be maintained and processed by third party service providers in the US or other jurisdictions. Our service providers are given the information they need to perform their designated functions, and we do not authorize them to use or disclose personal information for their own marketing or other purposes. WSI Brands and our Canadian, US and other service providers may provide your personal information in response to a search warrant or other legally valid inquiry or order, or to an organization in the case of a breach of an agreement or contravention of law, or as otherwise required or permitted by applicable Canadian, US or other law.

Safeguards and Retention

We maintain reasonable physical, electronic, and procedural safeguards to protect the personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure.

Personal Data We Collect

In connection with your application process we collect the following “Personal Data”: your name, email address, phone number, home address, prior employment history, education history, and other information that is capable of identifying you personally.

Personal Data Processing and Sharing

We process your Personal Data based on our legitimate interests, to provide services requested by you, and to comply with legal requirements. We process your Personal Data as necessary for us to evaluate your employment application and to provide you with services necessary to onboard you as an employee, should you receive a job offer from Company.

We will retain your Personal Data so long as necessary and as required by applicable law.

We may transfer your Personal Data to Company’s parent, subsidiary, and affiliated companies for the purposes listed above. We will take reasonable and appropriate security measures, including implementing standard contractual clauses, to provide for the safe transfer and storage of your Personal Data.

INDIA APPLICANT PRIVACY NOTICE

This Privacy Notice explains how Williams-Sonoma India Pvt. Ltd. ("WSIPL") collects, uses, discloses, and otherwise processes personal information about our India.-based associates, officers, directors, contractors, freelancers, contingent workers, consultants and other outsourced and temporary workers (collectively, "personnel"), and their family members or other individuals about whom we process personal information as a result of the relationships those individuals have with personnel (collectively, "related persons"). Personnel are required to provide a copy of this Privacy Notice to all related persons to whom this Privacy Notice applies.

This Privacy Notice is not a contract and does not create any legal rights or obligations. This Privacy Notice also is not intended to replace other notices or disclosures we may provide to you in connection with your role in our organization, which will supersede any conflicting disclosures contained in this Privacy Notice.

What is Personal Information?

When we use the term "personal information" in this Privacy Notice, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you within the context of your role as a member of our personnel or a related person. It does not include aggregated or anonymized information that is maintained in a form that is not capable of being associated with or reasonably linked to you. Our Collection and Use of Personal Information

The types of personal information we collect, the way we collect it and how we use it will depend on the relationship you have with us.

Personnel

Collection of Personal Information

In connection with your role as a member of our personnel, we collect certain personal information about you, which may include:

  • Contact Information: such as your full name, email address (personal and work), home address, business address, telephone number and emergency contact information.
  • Identification Materials: such as your image, national identification numbers, passport number, driver's license number or vehicle license plate number.
  • Professional Information: such as your hire date, employment location, business unit, department, supervisor, job title, position/grade, hours and days worked, working arrangement, work restrictions or accommodations, employee identification number, licenses and certifications, attendance, career goals, performance reviews, disciplinary records and information needed to establish your eligibility to work for us, including visa information.
  • Education & Training Information: such as your highest level of education, the schools you attended and when you were in attendance, degrees, certificates or other educational qualifications you earned.
  • Financial Information: such as your salary, bonus, benefits, expenses, stock or equity grants, bank account and routing information and corporate credit card number.
  • Benefits Information: such as your eligibility for benefits, information about your family members and other related persons under your benefits, and claims relating to your benefits.
  • Medical Information: such as observations, inquiry responses, and testing results.
  • Equal Opportunity Information: such as age, race, ethnicity, national origin, citizenship, sex, gender identity, sexual orientation, religion, disability or accommodation request, or marital or veteran status when you choose to provide it, but it will not be used in employment-related decisions unless specifically permitted by law.
  • Security Information: such as your work-related accounts and passwords, technical details about your use of work-related devices, your access to physical and electronic work-related locations, and photographs, videos and other visual images of you.
  • Other Work-Related Information: We also collect any personal information you choose to share with us or we receive from a third party in connection with your work for us, a grievance you are involved in, an agreement you enter into with us or additional roles you take on as a part of our organization.

Although we often collect the personal information described above directly from you, we also collect this information from supervisors, colleagues, customers, vendors, publicly available sources and other third parties you may interact with as a member of our personnel. In addition, we may also collect this information through service providers and other third parties that collect it on our behalf, such as communications providers, payroll providers and benefits providers.

Use of Personal Information

We use the personal information we collect about our personnel to:

  • Conduct organizational planning and development, including budget planning and administration;
  • Analyze and monitor compliance with our personnel and compliance policies and practices;
  • Administer recruiting, onboarding, staffing, leave, personnel evaluations, promotions, performance management, training, discipline, participation in available activities or programs and any other processing in connection with work-related purposes;
  • Authorize, grant, administer, monitor (including by video surveillance) and terminate access to or use of company systems, facilities, records, property and infrastructure;
  • Communicate with and between personnel, as well as with designated emergency contacts;
  • Support and manage personnel, including providing resources needed for personnel to perform their roles with us;
  • Facilitate personnel compensation, payroll, and benefit planning and administration (e.g., salary, tax withholding, insurance);
  • Conduct performance reviews and evaluations, as well as make decisions about promotions and job mobility;
  • Manage business travel (e.g., car service/rentals, flights, hotels) and personnel expenses (e.g., reimbursement, corporate credit card).
  • Operate our business, including marketing our personnel to customers, facilitating the work of our personnel and providing the products and services made available to our customers;
  • Investigate, document and report work-related injuries, illness or grievances;
  • Conduct internal investigations, audits, compliance, risk management, problem resolution and security operations;
  • Fulfill contractual obligations to you and other third parties;
  • Maintain a safe and healthy work environment;
  • Comply with applicable law, rule, regulation, legal proceeding and government investigations, including relating to tax reporting and immigration.

Related Persons

Collection of Personal Information

At times, we receive personal information about our personnel's family members and other related persons in connection with emergency contacts and the benefits and services we provide, which may include:

  • Contact Information: such as your full name, email address, home address, business address, telephone number and emergency contact information.
  • Identification Materials: such as your image national identification number, passport number, driver's license number or vehicle license plate number.
  • Benefits and Services Information: We also collect personal information necessary to extend the benefits and services that may be available to you as a family member or related person of our personnel, including insurance-related information, claims-related information, and disbursement-related information.

Although we often collect the personal information described above directly from you, we also collect this information from the personnel related to you, as well as our benefit administrators. In addition, we may also collect this information through service providers and other third parties that collect it on our behalf, such as communications providers.

Use of Personal Information

We use the personal information we collect about related persons to:

  • Communicate with you about benefits and services you are eligible for, events or activities our personnel invite you to, or in the event of an emergency;
  • Administer the benefits and services you are eligible for;
  • Respond to requests and inquiries you may send to us;
  • Conduct internal investigations, audits, compliance, risk management, problem resolution and security operations;
  • Fulfill contractual obligations to you and other third parties;
  • Comply with applicable law, rule, regulation, legal proceeding and government investigations, including relating to tax reporting and immigration.

Our Disclosure of Personal Information

We may share your personal information with the following third parties for the purposes described below:

  • Within Williams-Sonoma (which includes its affiliates in other jurisdictions): We share personal information relating to personnel and related persons within our family of companies for internal administrative purposes and uses that are consistent with this Privacy Notice. For example, the WSI entity responsible for payroll may receive personal information about personnel employed by another Williams-Sonoma entity in order to determine the proper compensation to be provided.
  • Benefit Administrators: In order to provide our personnel and related persons benefits and services available to them, we share personal information with the third parties we engage to offer and administer the benefits and services on our behalf. These third parties may also collect additional personal information from you in connection with these benefits and services, which will be subject to the relevant third party's own privacy policies and notices.
  • Payroll and Tax Providers: We share personal information with third parties who assist us in processing our payroll and other compensation-related obligations, including our tax withholding and reporting obligations.
  • Other Service Providers: In addition to the third parties identified above, we engage other third parties to perform certain functions on our behalf in connection with the uses of personal information described in the Our Collection and Use of Personal Information section above, including assisting us with our personnel management, benefits and services offerings and other related business operations. Depending on the function the third party serves, the service provider may process personal information on our behalf or have access to personal information while performing functions on our behalf.
  • Business Transaction or Reorganization: We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose personal information to a third party during negotiation of, in connection with or as an asset in such a corporate business transaction. Personal information may also be disclosed in the event of insolvency, bankruptcy, or receivership.
  • Legal Obligations and Rights: We may disclose personal information to third parties, such as legal advisors and law enforcement:
    • in connection with the establishment, exercise, or defense of legal claims;
    • to comply with laws and regulations or to respond to lawful requests and legal process;
    • to protect our rights and property and the rights and property of our agents, customers, and others, including to enforce our agreements, policies, and terms of use;
    • to detect, suppress, or prevent fraud;
    • to reduce credit risk and collect debts owed to us;
    • pursuant to orders issued by courts, tribunals and other authorities or pursuant to mandate under law;
    • when complying with legal process, for verification of identity, or for preventing, detecting, investigating and for prosecution and punishment of incidents including cyber incidents, fraud or imminent harm, and ensuring the security of our network and services;
    • to protect the health and safety of us, our customers, or any person; or
    • as otherwise required by applicable law.
  • Consent: We may disclose personal information about you to certain other third parties with your consent.

Storage and Retention

Your personal information will reside on WSIPL’s, servers or our vendor’s servers located in India and across the globe. It may also reside on our third-party service providers’ servers (including cloud servers), if your personal information is required to be disclosed to them in accordance with the terms of this privacy notice.

Data Security

WSIPL has implemented appropriate security practices and procedures designed to protect your personal information from accidental or unlawful destruction, loss, damage, alteration, unauthorized disclosure, unauthorized access, unauthorized use, etc. in accordance with applicable law.

Access and Accuracy

You have a right to review, update and correct your personal information that we hold. Kami akan menyimpan Data Pribadi Anda selama (i) hingga lima tahun] setelah selesainya proses lamaran kerja, jika lamaran kerja Anda ditolak atau (ii) sepanjang diperlukan untuk mempekerjakan Anda dan memberikan layanan-layanan kepada Anda sehubungan dengan hubungan kerja Anda dan sebagaimana disyaratkan berdasarkan hukum yang berlaku, jika proses lamaran kerja Anda berhasil sehingga Anda diterima bekerja di Kantor Perwakilan/Cabang.

Kami akan mentransfer Data Pribadi Anda ke luar negeri ke Singapura dan Amerika Serikat dan mengambil langkah-langkah keamanan yang wajar dan tepat, termasuk menerapkan klausul-klausul kontraktual yang standar, untuk mengatur transfer dan penyimpanan Data Pribadi Anda dengan aman sesuai dengan hukum yang berlaku.

Hak-hak Anda

This Notice explains how Williams-Sonoma Singapore Pte Ltd’s Foreign Trade Representative Office (Representative Office) / Foreign Trade Representative Office Branch (Branch Office) collects, uses, discloses, and otherwise processes Personal Data (as defined below) that is capable of identifying you personally.




Personal Data We Collect

In connection with your application process we collect the following personal data and other required data which is referred to in the employment application form that comes together with this Notice:

  • your name;
  • email address;
  • phone number;
  • home address;
  • prior employment history;
  • education history; and
  • other information that is capable of identifying you personally.

(collectively referred to as Personal Data).



Personal Data processing and sharing

We process your Personal Data based on our legitimate interests, to provide services requested by you, and to comply with legal requirements in accordance with applicable law. We will process your Personal Data as necessary for us to:

(a) evaluate your employment application and to provide you with services necessary to onboard you as an employee, should you receive a job offer from the Representative/Branch Office; and

We will transfer your Personal Data overseas to Singapore and the United States and take reasonable and appropriate security measures, including implementing standard contractual clauses, to provide for the safe transfer and storage of your Personal Data in accordance with applicable law.

We will disclose your Personal Data to the Representative/Branch Office principal company, its parent company and affiliated companies for the purposes listed above. We will disclose your Personal Data to our service providers and contractors who assist us with providing services necessary for the purposes listed above. Your Rights

With respect to your Personal Data, you have the right to:

Personnel

Collection of Personal Information

In connection with your role as a member of our personnel, we collect certain personal information about you, which may include:

  • Contact Information: such as your full name, email address (personal and work), home address, business address, telephone number and emergency contact information.
  • Identification Materials: such as your image, social security number or other national identification number, passport number, driver's license number or vehicle license plate number.
  • Professional Information: such as your hire date, employment location, business unit, department, supervisor, job title, position/grade, hours and days worked, working arrangement, work restrictions or accommodations, employee identification number, licenses and certifications, attendance, career goals, performance reviews, disciplinary records and information needed to establish your eligibility to work for us, including visa information.
  • Education & Training Information: such as your highest level of education, the schools you attended and when you were in attendance, degrees, certificates or other educational qualifications you earned.
  • Financial Information: such as your salary, bonus, benefits, expenses, stock or equity grants, bank account and routing information and corporate credit card number.
  • Benefits Information: such as your eligibility for benefits, information about your family members and other related persons under your benefits, and claims relating to your benefits.
  • Medical Information: such as observations, inquiry responses, immunization records and testing results.
  • Equal Opportunity Information: such as age, race, ethnicity, national origin, citizenship, sex, gender identity, sexual orientation, religion, disability or accommodation request, or marital or veteran status when you choose to provide it, but it will not be used in employment-related decisions unless specifically permitted by law.
  • Security Information: such as your work-related accounts and passwords, technical details about your use of work-related devices, your access to physical and electronic work-related locations, and photographs, videos and other visual images of you.
  • Other Work-Related Information: We also collect any personal information you choose to share with us or we receive from a third party in connection with your work for us, a grievance you are involved in, an agreement you enter into with us or additional roles you take on as a part of our organization.

Although we often collect the personal information described above directly from you, we also collect this information from supervisors, colleagues, customers, vendors, publicly available sources and other third parties you may interact with as a member of our personnel. In addition, we may also collect this information through service providers and other third parties that collect it on our behalf, such as communications providers, payroll providers and benefits providers.

Use of Personal Information

We use the personal information we collect about our personnel to:

  • Conduct organizational planning and development, including budget planning and administration;
  • Analyze and monitor compliance with our personnel and compliance policies and practices;
  • Administer recruiting, onboarding, staffing, leave, personnel evaluations, promotions, performance management, training, discipline, participation in available activities or programs and any other processing in connection with work-related purposes;
  • Authorize, grant, administer, monitor (including by video surveillance) and terminate access to or use of company systems, facilities, records, property and infrastructure;
  • Communicate with and between personnel, as well as with designated emergency contacts;
  • Support and manage personnel, including providing resources needed for personnel to perform their roles with us;

Related Persons

Collection of Personal Information

At times, we receive personal information about our personnel's family members and other related persons in connection with emergency contacts and the benefits and services we provide, which may include:

  • Contact Information: such as your full name, email address, home address, business address, telephone number and emergency contact information.
  • Identification Materials: such as your image, social security number or other national identification number, passport number, driver's license number or vehicle license plate number.
  • Benefits and Services Information: We also collect personal information necessary to extend the benefits and services that may be available to you as a family member or related person of our personnel, including insurance-related information, claims-related information, and disbursement-related information.

Although we often collect the personal information described above directly from you, we also collect this information from the personnel related to you, as well as our benefit administrators. In addition, we may also collect this information through service providers and other third parties that collect it on our behalf, such as communications providers.

Use of Personal Information

We use the personal information we collect about related persons to:

  • Communicate with you about benefits and services you are eligible for, events or activities our personnel invite you to, or in the event of an emergency;
  • Administer the benefits and services you are eligible for;
  • Respond to requests and inquiries you may send to us;
  • Conduct internal investigations, audits, compliance, risk management, problem resolution and security operations;
  • Fulfill contractual obligations to you and other third parties;
  • Comply with applicable law, rule, regulation, legal proceeding and government investigations, including relating to tax reporting and immigration.

Our Disclosure of Personal Information

We may share your personal information with the following third parties for the purposes described below:

  • Within WSI: We share personal information relating to personnel and related persons within our family of companies for internal administrative purposes and uses that are consistent with this Privacy Notice. For example, the WSI entity responsible for payroll may receive personal information about personnel employed by another WSI entity in order to determine the proper compensation to be provided.
  • Benefit Administrators: In order to provide our personnel and related persons benefits and services available to them, we share personal information with the third parties we engage to offer and administer the benefits and services on our behalf. These third parties may also collect additional personal information from you in connection with these benefits and services, which will be subject to the relevant third party's own privacy policies and notices.
  • Payroll and Tax Providers: We share personal information with third parties who assist us in processing our payroll and other compensation-related obligations, including our tax withholding and reporting obligations.
  • Other Service Providers: In addition to the third parties identified above, we engage other third parties to perform certain functions on our behalf in connection with the uses of personal information described in the Our Collection and Use of Personal Information section above, including assisting us with our personnel management, benefits and services offerings and other related business operations. Depending on the function the third party serves, the service provider may process personal information on our behalf or have access to personal information while performing functions on our behalf.
  • Business Transaction or Reorganization: We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose personal information to a third party during negotiation of, in connection with or as an asset in such a corporate business transaction. Personal information may also be disclosed in the event of insolvency, bankruptcy, or receivership.
  • Legal Obligations and Rights: We may disclose personal information to third parties, such as legal advisors and law enforcement:

This Notice does not apply to personal information that is governed by the Health Insurance Portability and Accountability Act of 1996, the Gramm-Leach-Bliley Act, the Fair Credit Reporting Act, or the California Financial Information Privacy Act as permitted by State Privacy Laws.

You can request the specific pieces of Personal Information we have collected about you.

Please note that we may not be able to provide you with all of your personal information, if doing so would:

  • Disclose our trade secrets;
  • Violate an evidentiary privilege;
  • Adversely affect the rights and freedoms of others;
  • Restrict our ability to:
    • Comply with law or a legal or regulatory inquiry, investigation, subpoena, or summons;
    • Cooperate with certain law enforcement or government agency requests;
    • Exercise or defend legal claims;
    • Collect or use information that is deidentified or aggregated.

Right to Deletion

You can also request that we delete your Personal Information that we have collected from you. We may not delete all of your Personal Information if one of the following exceptions applies:

  • Security: to detect data security incidents; preserve the integrity or security of systems; or investigate, report, or prosecute those responsible for any such action;

You must provide us with your full name and answers to at least three of the following questions: (1) What was the month and year of your hiring date?; (2) What is your WSI employee ID number?; (3) What was your last job title with WSI?; (4) What is your WSI store number or name of your corporate location? Failure to provide all of the foregoing information will prevent us from processing your request. Further, in order to verify your identity, we will match that information to the information we have on our systems.

Do Not Sell or Share My Personal Information

We do not knowingly "sell" or "share" the personal information of employees. Under State Privacy Laws, "sell" means renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a your personal information by us to another business or a third party for monetary or other valuable consideration. Under State Privacy Laws, "share" means disclosing your personal information by us to a third party for cross-context behavioral advertising, in exchange for money or anything else of value.

Non-Discrimination

We will not discriminate against you for exercising any of your Rights under State Privacy Laws and we will not deny you goods or services, charge you a different price, or provide you with a lesser quality of services if you exercise any of your rights under State Privacy Laws.

Sensitive Personal Information

We do not collect or process Sensitive Personal Information, as defined by California law, for inferring characteristics or use or disclose Sensitive Personal Information for purposes other than those permitted by law.

This Privacy Notice explains how Williams-Sonoma Vietnam LLC ("WSVN") collects, uses, discloses, and otherwise processes personal information about our U.S.-based associates, officers, directors, contractors, freelancers, contingent workers, consultants and other outsourced and temporary workers (collectively, "personnel"), and their family members or other individuals about whom we process personal information as a result of the relationships those individuals have with personnel (collectively, "related persons"). Personnel are required to provide a copy of this Privacy Notice to all related persons to whom this Privacy Notice applies.

This Privacy Notice is not a contract and does not create any legal rights or obligations. This Privacy Notice also is not intended to replace other notices or disclosures we may provide to you in connection with your role in our organization, which will supersede any conflicting disclosures contained in this Privacy Notice.

What is Personal Information?

When we use the term "personal information" in this Privacy Notice, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you within the context of your role as a member of our personnel or a related person. The types of personal information we collect, the way we collect it and how we use it will depend on the relationship you have with us.

Personnel

Collection of Personal Information

In connection with your role as a member of our personnel, we collect certain personal information about you, which may include:

  • Contact Information: such as your full name, email address (personal and work), home address, business address, telephone number and emergency contact information.
  • Identification Materials: such as your image, identification card number or other national identification number, passport number, driver's license number or vehicle license plate number.
  • Professional Information: such as your hire date, employment location, business unit, department, supervisor, job title, position/grade, hours and days worked, working arrangement, work restrictions or accommodations, employee identification number, licenses and certifications, attendance, career goals, performance reviews, disciplinary records and information needed to establish your eligibility to work for us, including visa information.
  • Education & Training Information: such as your highest level of education, the schools you attended and when you were in attendance, degrees, certificates or other educational qualifications you earned.
  • Financial Information: such as your salary, bonus, benefits, expenses, stock or equity grants, bank account and routing information and corporate credit card number.
  • Benefits Information: such as your eligibility for benefits, information about your family members and other related persons under your benefits, and claims relating to your benefits.
  • Medical Information: such as observations, inquiry responses, and testing results.
  • Equal Opportunity Information: such as age, race, ethnicity, national origin, citizenship, sex, gender identity, sexual orientation, religion, disability or accommodation request, or marital or veteran status when you choose to provide it, but it will not be used in employment-related decisions unless specifically permitted by law.
  • Security Information: such as your work-related accounts and passwords, technical details about your use of work-related devices, your access to physical and electronic work-related locations, and photographs, videos and other visual images of you.
  • Other Work-Related Information: We also collect any personal information you choose to share with us or we receive from a third party in connection with your work for us, a grievance you are involved in, an agreement you enter into with us or additional roles you take on as a part of our organization.

Although we often collect the personal information described above directly from you, we also collect this information from supervisors, colleagues, customers, vendors, publicly available sources and other third parties you may interact with as a member of our personnel. In addition, we may also collect this information through service providers and other third parties that collect it on our behalf, such as communications providers, payroll providers and benefits providers.

Use of Personal Information

We use the personal information we collect about our personnel to:

  • Conduct organizational planning and development, including budget planning and administration;
  • Analyze and monitor compliance with our personnel and compliance policies and practices;
  • Administer recruiting, onboarding, staffing, leave, personnel evaluations, promotions, performance management, training, discipline, participation in available activities or programs and any other processing in connection with work-related purposes;
  • Authorize, grant, administer, monitor (including by video surveillance) and terminate access to or use of company systems, facilities, records, property and infrastructure;
  • Communicate with and between personnel, as well as with designated emergency contacts;
  • Support and manage personnel, including providing resources needed for personnel to perform their roles with us;
  • Facilitate personnel compensation, payroll, and benefit planning and administration (e.g., salary, tax withholding, insurance);
  • Conduct performance reviews and evaluations, as well as make decisions about promotions and job mobility;
  • Manage business travel (e.g., car service/rentals, flights, hotels) and personnel expenses (e.g., reimbursement, corporate credit card).
  • Operate our business, including marketing our personnel to customers, facilitating the work of our personnel and providing the products and services made available to our customers;
  • Investigate, document and report work-related injuries, illness or grievances;
  • Conduct internal investigations, audits, compliance, risk management, problem resolution and security operations;
  • Fulfill contractual obligations to you and other third parties;
  • Maintain a safe and healthy work environment;
  • Comply with applicable law, rule, regulation, legal proceeding and government investigations, including relating to tax reporting and immigration.

Related Persons

Collection of Personal Information

At times, we receive personal information about our personnel's family members and other related persons in connection with emergency contacts and the benefits and services we provide, which may include:

  • Contact Information: such as your full name, email address, home address, business address, telephone number and emergency contact information.
  • Identification Materials: such as your image, identification card number or other national identification number, passport number, driver's license number or vehicle license plate number.
  • Benefits and Services Information: We also collect personal information necessary to extend the benefits and services that may be available to you as a family member or related person of our personnel, including insurance-related information, claims-related information, and disbursement-related information.

Although we often collect the personal information described above directly from you, we also collect this information from the personnel related to you, as well as our benefit administrators. In addition, we may also collect this information through service providers and other third parties that collect it on our behalf, such as communications providers.

Use of Personal Information

We use the personal information we collect about related persons to:

  • Communicate with you about benefits and services you are eligible for, events or activities our personnel invite you to, or in the event of an emergency;
  • Administer the benefits and services you are eligible for;
  • Respond to requests and inquiries you may send to us;
  • Conduct internal investigations, audits, compliance, risk management, problem resolution and security operations;
  • Fulfill contractual obligations to you and other third parties;
  • Comply with applicable law, rule, regulation, legal proceeding and government investigations, including relating to tax reporting and immigration.

Our Disclosure of Personal Information

We may share your personal information with the following third parties for the purposes described below:

  • Within WSVN: We share personal information relating to personnel and related persons within our family of companies for internal administrative purposes and uses that are consistent with this Privacy Notice. For example, the WSVN entity responsible for payroll may receive personal information about personnel employed by another WSVN entity in order to determine the proper compensation to be provided.
  • Benefit Administrators: In order to provide our personnel and related persons benefits and services available to them, we share personal information with the third parties we engage to offer and administer the benefits and services on our behalf. These third parties may also collect additional personal information from you in connection with these benefits and services, which will be subject to the relevant third party's own privacy policies and notices.
  • Payroll and Tax Providers: We share personal information with third parties who assist us in processing our payroll and other compensation-related obligations, including our tax withholding and reporting obligations.
  • Other Service Providers: In addition to the third parties identified above, we engage other third parties to perform certain functions on our behalf in connection with the uses of personal information described in the Our Collection and Use of Personal Information section above, including assisting us with our personnel management, benefits and services offerings and other related business operations. Depending on the function the third party serves, the service provider may process personal information on our behalf or have access to personal information while performing functions on our behalf.
  • Business Transaction or Reorganization: We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose personal information to a third party during negotiation of, in connection with or as an asset in such a corporate business transaction.   • Legal Obligations and Rights: We may disclose personal information to third parties, such as legal advisors and law enforcement:

6. PROTECTION DES RENSEIGNEMENTS PERSONNELS. Ainsi, tout différend futur pouvant survenir entre les parties (y compris entre l’utilisateur et tout tiers mandataire de WSI), en vertu d’un contrat, d’une loi, d’un délit, d’une fraude, d’une information fausse ou trompeuse, de la discrimination, de la common law ou d’une autre théorie du droit, y compris, notamment, tout différend ou toute réclamation se rapportant à ce qui suit : un congédiement injustifié; un préjudice personnel, physique ou émotionnel; une diffamation; le salaire ou toute autre rémunération; des titres de capitaux propres, des options, des actions ou toute participation; des pénalités; des avantages sociaux; le remboursement des dépenses; de la discrimination ou du harcèlement, y compris, notamment, de la discrimination ou du harcèlement fondé sur la race, la couleur, le genre, la grossesse, la religion, le pays d’origine, l’ascendance, l’âge, l’état matrimonial, une incapacité physique, une incapacité mentale, un problème de santé, l’orientation sexuelle ou toute autre caractéristique protégée par la loi; des représailles; la violation d’une loi, d’un règlement, d’une ordonnance ou de la constitution d’un gouvernement fédéral, étatique, provincial ou autre (dans sa version adoptée initialement et dans sa version modifiée); l’établissement, l’exécution ou l’interprétation des présentes Modalités; les relations entre les parties, y compris le type de relation; ainsi que les réclamations et autres différends aux termes, entre autres, des lois, codes et ordonnances suivants : Civil Rights Act of 1964 (Title VII); Age Discrimination in Employment Act of 1967; Americans with Disabilities Act; Fair Labor Standards Act; Employee Retirement Income Security Act; Consolidated Omnibus Budget Reconciliation Act; Family and Medical Leave Act; California Fair Employment and Housing Act; California Family Rights Act; California Labor Code; California Civil Code; California Wage Orders, ou toute autre loi ou règlement fédéral, étatique, provincial ou local, quel que soit le moment où ces réclamations ou ces différends sont respectivement présentées ou soulevés et dans la mesure où ils ne peuvent pas être réglés par les parties elles-mêmes, seront réglés de façon définitive et exécutoire au moyen d’un arbitrage qui se déroulera à San Francisco, en Californie, conformément à la loi intitulée Federal Arbitration Act et conformément aux Employment Arbitration and Mediation Rules alors en vigueur de l’American Arbitration Association, lesquelles sont disponibles au www.adr.org. WSI prendra en charge l’ensemble des frais et coûts relatifs au processus d’arbitrage, mais il est entendu que chacune des parties devra acquitter les honoraires d’avocats, les frais ou les autres dépenses qu’elle engage, notamment à l’égard de dépositions, de témoins ou d’experts, comme si l’affaire avait été portée devant un tribunal. Dans le cadre de toute procédure d’arbitrage qui se déroule conformément au présent paragraphe, les parties ont le droit d’obtenir la communication de la preuve, d’assigner des témoins et de contre-interroger les témoins de l’autre partie. L’arbitre rend par écrit une décision finale mentionnant les motifs de la sentence arbitrale. Les deux parties sont liées par la présente convention d’arbitrage, mais celle-ci ne couvre pas les différends qui, selon la loi, ne peuvent pas être soumis à l’arbitrage. 11. MODIFICATION DES PRÉSENTES MODALITÉS

Nous pouvons apporter des modifications aux présentes Modalités. Le cas échéant, nous le signalerons en affichant les Modalités modifiées sur le Site. Ces modifications entreront en vigueur à la date de révision indiquée sur les Modalités révisées. Si vous continuez d’utiliser le Site, vous êtes réputé avoir accepté les Modalités révisées.
